Terms and Conditions

Definitions

The Sony Style Points Programme ("Programme") is owned and operated by Sony (Malaysia) Sdn. Bhd. (16202-H) ("Sony").

Points Programme

Individuals who are resident in Malaysia are eligible to participate in the Programme. Such participation is governed by the terms and provisions set out herein. By participating in this Programme you acknowledge that you are fully aware of the contents herein.

Anyone who wishes to participate in the Programme may apply to be issued with a Points Programme Card ("Sony Style Card"). Applications may be made by completing and submitting an application at the Sony Direct Store

Sony reserves the rights to refuse an application for participation in the Programme without being obliged to give any reason for the same.

One becomes eligible to participate in the Programme by :-

(a)	Making a minimum purchase of RM200 nett on a single receipt at either Sony Direct Store or Sony Style Online. For the avoidance of doubt, such purchases do not include the value of items purchased or redeemed by use of any gift vouchers or certificates. Customers are required to produce the original receipt upon making the application;
(b)	By making an application to be issued with and purchasing the Sony Style Card for RM50 at the Sony Direct Store; or
(c)	By making an application to be issued with the Sony Style Card after purchasing Gift Cards in the following amounts :-. (i) RM100 (ii) RM200 (iii) RM500 and (iv) RM1000

Sony may at its discretion credit additional points into any Sony Style Card at the time of issuance, except where the Sony Style Card is obtained via the purchase of Gift Cards.

Participants in the Programme must notify Sony immediately in the event that there is a change of address, or email address; or in the event that a Sony Style Card is lost or stolen.

This Programme shall be operative until such time as shall be notified by Sony. Such notifications shall be posted on the website at www.sonystyle.com.my, and may at Sony's discretion be displayed at the Sony Style Offline stores, and you are encouraged to visit the web-site regularly for updates.

Sony reserves the right to terminate an individual's participation in the Programme without notice in the event of;

a.	a breach of any of these terms and conditions and any terms and conditions which may thereafter be set by Sony for continued participation in the Programme;
b.	the supply at any time of misleading information or the making of any misrepresentation to Sony,
c.	the abuse of any privilege accorded to any cardholder under the Programme,
d.	the undertaking or facilitation of any fraudulent activity under or through the Programme,
e.	the individual becoming deceased;
f.	the individual being declared a bankrupt, or
g.	the individual displaying inappropriate or harassing, menacing or threatening behaviour against any other cardholder, customer or staff of Sony

10.

Termination of the Points Programme will result in forfeiture of points remaining in cardholder's account. For the purposes of these terms and conditions, "cardholder" and "participant" mean a person whose application in paragraph 3 has been approved and who has been issued a Sony Style Card.

11.

The Cardholder reserves the rights to terminate his or her participation in the Programme by giving notice in writing to Sony (Malaysia).

12.

Points rewarded are not transferable, to either a new cardholder or an existing cardholder.

13.

Sony may communicate the award of points, the commencement of promotional programmes as well as forward catalogues in such manner and at such times as it deems fit, whether by email, post or shop front displays.

14.

The Card does not have a pre-set expiry date. However, in the event of the cessation of the Points Programme, the card will automatically become inactive.

15.

Points redeemed under the Programme and receipts issued for such redemption cannot be used to activate another Sony Style Card.

16.

Only one Sony Style Card will be issued to any one participant in the Programme. The participant shall not be entitled to a second Sony Style Card merely upon making another minimum purchase as described in paragraph 5(a) above.

17.

The Sony Style card ownership is not transferable.

Collecting Points

18.

Points will be recorded in a database kept by Sony which is accessible on the Internet at www.sonystyle.com.my or at the Sony Direct Store. Point Collected are valid for 1 year from the date of last purchase made.

19.

Points will be awarded under the Programme for subsequent purchases above RM50 except VAIO notebook & PlayStation Product on a single receipt at any Sony Style retail outlet. The number of points to be awarded for the purchase of any product shall be set by Sony at its discretion.

20.

Sony may in addition award additional points for the purchase of certain specified products or products on promotion.

21.

Each point rewarded is equivalent to RM1.

22.

The participant shall obtain the points, in the following manner;

a.	By presenting the Sony Style Card and notifying Sony Direct Store personnel before the purchase is made, or
b.	If the purchase is made via telephone, by quoting Name, NRIC / Passport, or
c.	By keying in the card number when making an online purchase before completing the 'add-to-cart' process.

23.

Sony may at any time and from time to time introduce other methods or avenues at its discretion by which a cardholder may receive points.

24.

Points cannot be redeemed until it is credited into the card.

25.

Points rewarded cannot be exchanged for cash.

26.

In the event a cardholder owns 2 separate Sony Style Cards; the cardholder has the option to choose to accumulate points in one card ONLY.

27.

In addition, if cardholder has not activated the 2nd card, the cardholder may choose to have the points credited into the activated card, in which event the points may be credited into that Sony Style Card and shall not be transferred into the 2nd Sony Style Card.

28.

The combination of points awarded to a participant in separate cards may only be carried out at the Sony Style KLCC outlet.

29.

The application for the issuance of a Sony Style Card or a request for the award of points must be made on the day of purchase. Past purchase receipts will not be accepted for the accumulation of points or for the issuance of any Sony Style Card .

30.

Points will only be rewarded for online purchases once the payment is made which does not include Service Payment.

Redemption

31.

Redemption of points shall be carried out in accordance with the redemption methods described either online at www.sonystyle.com.my or offline at Sony Sony Direct Store.

32.

There are no minimum points for redemption.

33.

Once a redemption is made, the cardholder is not allowed to exchange or cancel the same or else seek a refund as points deducted will not be reinstated.

34.

Redeemed Sony products will be covered by the usual warranties, terms and conditions applicable to the product in question.

35.

Points can be used for Service Charges at Sony Style KLCC only.It may not be used in respect of Service Charges at Sony Headquarters and Branch Service Centers, Spare Parts Department or for outdoor services.

36.

Mutiple cardholders are not allowed to combine their points for redemption.

37.

Points can be used for My Sony Activities except for My Sony Auction.

38.

Redemption may be carried out as long as the Points Programme is active.

39.

The Sony Style Card, or, in the case of an online transaction, the Sony Style Card ID (NRIC / Password) is to be furnished for verification prior to redemption. The cardholder shall provide the password in the latter case if required.

40.

Partial redemption may be made by using both points and cash or credit card.

41.

In the event of partial redemption, the amount paid by cash or credit card may be awarded with points under the Programme [provided that such amount exceeds RM50]..

42.

For cardholders who have purchased offline but choose to redeem or accumulate points online, password verification is required.

43.

All products for redemption are subjected to stock availability.

Reservation of order (pre-order via online)

44.

Cardholders are allowed to reserve or pre-order a product which is temporarily out of stock either online or through a Sony Direct Store. Once the stock is available, the reservation will only be processed for the purposes of redemption subject to the terms and conditions of redemption herein and with prior notification via email to the cardholder.

45.

However, in the event of certain redemption promotion such pre-order or reservation order is not applicable and will be notified at shop front.

Deduction of points

46.

There is expiry period for the use of points awarded. Validity of Points is 1 year from the date of last purchase made.

47.

Sony reserves the rights to deduct the points balance in a cardholder's account, in the event that Sony has reason to believe that:

a.	points have been recorded by any misrepresentation or fraud;
b.	points have been rewarded in respect of a transaction or purchase which has been cancelled; or
c.	points have been awarded due to an error whether by Sony, the cardholder or any other person.

General

48.

Sony Style Cards are not transferable and remain the property of Sony at all times.

49.

Points that are awarded are not valid for sale, transfer, or assignment to another individual or and may not be otherwise dealt with except in accordance with the terms and conditions set out herein.

50.

Without derogating from paragraph 48, Sony may in its absolute discretion allow the transfer of points to another individual or to another Card held by that participant in question.

51.

Sony reserves the rights to change the terms and conditions at any time without prior notice and shall post such changes at its web-site at www.sonystyle.com.my. It is the participant's responsibility to access the web-site regularly to keep himself appraised of the terms and conditions in force. Without derogating from the aforesaid, Sony may at its discretion notify cardholders via email of any changes.

52.

Sony shall not be liable to any participant or any third party for any loss or damage whatsoever or howsoever caused arising directly or indirectly in connection with the terms and conditions set out herein or sustained by reason of or incidental to any performance, action, omission, failure or delay in or interruption in the performance of any act or service in relation the Programme, including but not limited to the following :-

(a)	Any redemption or use of points which is unauthorised by the participant in question;
(b)	Any failure to notify cardholders of any changes in the terms and conditions herein or of, promotional events or bonus points awarded;
(c)	Any failure to notify any person of the termination and/or suspension of the Programme;
(d)	Any failure of, or interruption in any computer system used in relation to the Programme, including the Sony Style Online Webstore.

53.

Sony expressly excludes liability for consequential loss, damage or for wasted expenditure, or for loss of profit, business, revenue goodwill or anticipated savings.

54.

An administrative fee of RM10 is charged on any request to replace lost card. If cardholder has sufficient points, he/she may utilise the points to redeem for the replacement of lost card / offset the administrative fee.

55.

Sony shall be under no liability in respect of any loss or which may be suffered or incurred or which may arise directly or indirectly in respect of the acts or omissions of any third party, including any loss or theft of, or damage to any gift/product in the course of delivery

56.

Without prejudice to the generality of paragraph 52, the participant acknowledges that due to the nature of the Internet and its underlying technologies, Sony is unable to warrant that its servers shall be completely secure from hacking, unauthorised access or malicious attack. Sony shall not be liable to the participant or any third party for any loss or damage caused by or arising out of any such unauthorised access or malicious attack.

Personal Data Policy

If you are under 13 years of age, please get the consent of your parent or guardian before making any on-line transactions. You may only request for services or place orders for products through your parents or guardians. We urge parents or guardians to explain Internet safety to their children. Parents are urged to spend time online with their children to become familiar with the types of content available on the Site and the Internet in general.

At Sony we believe our cardholders have a right to know about our practices regarding the information we may collect when you visit our offline store or our web store as well as the type of information collected. The guidelines contained herein apply only to the Sony Style Point Programme, operated by Sony (M) Sdn Bhd ("SOMAS"). Other participating Sony sites which are linked to/from these sites may have different policies which apply to their collection of data; therefore, please review the privacy policy notices on those sites for details.

In using this programme, you consent to the collection, storage, use and disclosure of your personal information in accordance with the terms and provisions of this policy. The terms and conditions of this policy must be read in conjunction with all other terms and conditions applicable for the use of the Sony Style Points Programme.

We collect personal information from you so that we can continually improve and to provide better personalize services through Sony Style Malaysia. We may obtain personal information from you in the following ways:-

a)	Through information that you provide us - you will be requested to provide information about yourself during the registration process. Such information will include your name, nationality, address, e-mail, NRIC No (if applicable) or passport number which are required in mandatory fields. You may additionally be requested to provide further information (such as Date of Birth, race, contact number and interest) through optional fields in order for you to take advantage of certain promotions or obtain certain products or services
b)	Through information that we collect automatically from you - we may send cookies to your browser for this purpose. These cookies will be stored on your computer's hard drive and such cookies will not retrieve information from your computer unless you have set your browser to allow third parties to extract such information; and
c)	Information obtained from the contents of your correspondences and e-mails to us.

Further, it may be necessary for you to provide us with other personal information upon request in order for you to participate in specific Sony Style promotion or activity and for us to provide you with various products and/or services. Although you are not obliged to provide the information to us, failure to do so may result in you being unable to participate in the promotions and activities concerned or in us being unable to sell our products and/or provide certain services including after sales services to you. All such information provided will be stored and used by us pursuant to the terms of this Privacy Policy.

Your information and records described above (hereinafter referred to as the "Information") will be stored and maintained in our database for such time as is necessary to carry out the purposes set out below and will be kept in confidence by us.

We intend to use the Personal Information to:

1)	Track cardholder's traffic patterns throughout our site for the purpose of evaluating and enhancing its usability
2)	Identify individual cardholders in order for us to tailor our site and services to said cardholder
3)	Provide cardholders with the latest product/service information and promotion updates
4)	Ask the cardholder's opinion regarding our products and/or services
5)	Issue specific or personalized correspondences to you
6)	Make available various promotional activities for your participation and enjoyment

For the purposes described above, our company may share the Information with other departments in our company and/or any associated company in the Sony Group either in Malaysia or overseas. The Personal Information may be shared with third parties for the purpose of performing our obligations under a sale and purchase contract and/or any other contract between you and our company and/or to the extent necessary to provide any other services to you at your request. In such case, our company will endeavour to ensure that the recipients do not use the Information other than for the limited purpose of such disclosure within the terms of this policy, and will endeavour to ensure that they secure the Information from unauthorized use.

You hereby acknowledge that we may be required to disclose the Information to third parties in compliance with provisions of applicable law, the requirements of competent regulatory authorities or by an order of court. Save as is otherwise expressly stated in this policy we shall not disclose such information to third parties.

The Sony Style offline or online store may have combined promotions which include links to other web sites owned or operated by third parties. Such third parties may include other companies in the Sony Group. Please be advised however that Sony does not control such linked sites, and is neither responsible for the privacy policies and practices of such sites nor for collection, disclosure and/or use of your personal information provided by you during your access to or use of such sites. Your access to such linked sites, and your provision of personal information to such sites, are entirely at your own risk. For the avoidance of doubt, Sony shall not in any way be liable to you or to any third party for any loss or damage whatsoever and howsoever caused arising out of or in connection with your access to or use of such linked sites, or the activities and/or privacy policies and practices of the owners or operators of such linked sites

Sony shall take reasonable steps having regard to standards generally prevailing in the industry to keep such Information confidential. However, as no form of data transmission or storage can be guaranteed as totally secure, Sony does not and cannot warrant that the transmission or storage of the Information shall be absolutely free from interception or unauthorized access.

Please note that it is your responsibility to take all necessary steps to ensure the security and confidentiality of all user Ids and password provided by Sony. Sony shall not be liable to you or to any third party in any way whatsoever for any loss and damage caused by or arising out of the use, misuse or unauthorized use of any such Ids or passwords.

The terms of this policy will govern the use and any information collected while it is in place. Sony (Malaysia) Sdn Bhd reserves the rights to modify, change or vary this policy or any part thereof at any time, so please re-visit this page regularly to ascertain any such changes. Changes in this policy are effective at the time they are posted on the site.
